These Terms of Service ("Terms") are an agreement between you and Degenerates Studio ("we", "us"), the maker of the ApexArcade app (the "App"). By creating an account or using the App you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the App.
You must be at least 18 years old to create an account. You may have one account. The weekly prize is open only to eligible players described in the Official Rules. Some games are not available in some US states; the App shows which, and may ask for your location to check (see the Privacy Policy).
Give us accurate information and keep your password to yourself; you are responsible for what happens on your account. If you forget your password you can reset it from the sign-in screen with a code we email you. You can delete your account at any time in Settings → Delete account.
The App has two virtual currencies.
Credits and prestige are a limited license to use features of the App. They have no cash value, cannot be exchanged for money or anything of value, and are not your property. Purchases are final except where the law or Apple's refund policies say otherwise; if Apple refunds a purchase, the credits it bought are removed from your account. We may change how credits and prestige work, and they end if your account is closed.
The App has skill games, played for credits or prestige, and games of chance (Apex 21 blackjack against the dealer, and Apex Ascent), played for prestige only. No real money is ever wagered or paid out in any game. Results are decided by our servers; if something goes wrong (for example, a server restart), a round may be cancelled and stakes returned. Practice modes use play chips with no value.
Each week the player with the highest weekly prestige score can win the prize shown in the App. No purchase is necessary to take part or to win, and buying credits does not improve your chances. The Official Rules (Leaderboard → Official Rules) govern the prize. Apple is not a sponsor of, and is not involved in, any promotion in the App.
We have zero tolerance for objectionable content and abusive users. You agree not to:
You can report a player from the leaderboard, your friends list or a match, and block anyone you don't want to hear from. We review reports within 24 hours. We may change an offensive username, remove prestige or credits gained unfairly, disqualify a player from the prize, and suspend or permanently ban accounts, with or without notice.
You can stop using the App and delete your account at any time. We may suspend or end your access if you break these Terms or if we stop offering the App. Sections 3, 8, 9, 10 and 12 continue after your access ends.
The App is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the App will be uninterrupted, error-free or always available.
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, and our total liability for any claim about the App is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.
You agree to cover our losses and costs (including reasonable legal fees) from any claim that arises from your breaking these Terms or the law.
These Terms are between you and Degenerates Studio, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App (if any); to the maximum extent the law allows, Apple has no other warranty obligation. Apple is not responsible for any claims by you or anyone else relating to the App or your use of it, including product liability claims, claims that the App fails to meet any legal or regulatory requirement, and claims under consumer protection or privacy laws. If anyone claims that the App infringes their intellectual property rights, we, not Apple, are responsible for dealing with that claim. You confirm that you are not in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must also follow the App Store's terms of service.
These Terms are governed by the laws of the United States and of the state in which Degenerates Studio is based, without regard to conflict-of-law rules. Before filing a claim, please email us so we can try to resolve it. Any claim must be brought individually, not as part of a class or representative action, to the extent the law allows.
We may update these Terms. If a change is significant we'll tell you in the App. Using the App after an update means you accept it.
